Terms of Service

These Terms of Service ("Terms") govern your access to and use of PostAway, a social media scheduling and automation platform operated by Messina Enterprises LLC ("we," "our," or "us"), available at getpostaway.com. By using PostAway, you agree to these Terms.

1. Eligibility

You must be at least 13 years of age to use PostAway. By using the service, you represent that you meet this requirement and that you have the authority to enter into a binding agreement with us.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at business@jennifercmessina.com if you suspect unauthorized access to your account.

3. Acceptable Use

You agree to use PostAway only for lawful purposes and in accordance with these Terms. You agree not to:

Violate any applicable laws or regulations, including those of Instagram, TikTok, or any other connected platform
Post or schedule content that is unlawful, harmful, defamatory, obscene, or invasive of another's privacy
Use the service to send spam, unsolicited messages, or engage in any deceptive practices
Attempt to gain unauthorized access to any part of the service or its related systems
Interfere with or disrupt the integrity or performance of the service
Reverse engineer, decompile, or otherwise attempt to extract the source code of the service

4. Connected Social Accounts

PostAway connects to third-party platforms including Instagram and TikTok via their official APIs. By connecting your accounts, you authorize PostAway to access and post content on your behalf as directed by you. You are solely responsible for all content you schedule or publish through the service.

Your use of connected platforms is also governed by those platforms' own terms of service. PostAway is not affiliated with, endorsed by, or sponsored by Instagram, TikTok, or Meta.

5. Subscription and Payment

PostAway offers a free plan and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at signup. All payments are processed securely through Stripe. Subscription fees are non-refundable except as required by applicable law.

We reserve the right to change pricing at any time with reasonable notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

6. Intellectual Property

PostAway and its original content, features, and functionality are owned by Messina Enterprises LLC and are protected by applicable intellectual property laws. You retain all rights to the content you create and schedule through the service.

By using PostAway, you grant us a limited, non-exclusive license to process and transmit your content solely as necessary to provide the service.

7. Disclaimers

PostAway is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that content will always publish successfully to connected platforms, as third-party API availability is outside our control.

8. Limitation of Liability

To the fullest extent permitted by law, Messina Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to PostAway at any time if you violate these Terms or if we determine, in our sole discretion, that your use of the service is harmful to us, other users, or third parties. You may cancel your account at any time from your account settings.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
